New Geneanet Privacy Policy and Terms & Conditions Changes
In this article, we would like to explain the changes which we are bringing to the Terms and Conditions of Use (ToS) of the Geneanet website, effective October 1, 2021.
The most important change is our new Privacy Policy describing our management of personal data, as required by the General Data Protection Regulation (GDPR). This addition is designed to fully respect the GDPR’s requirements.
As a result, all references concerning management of personal data have been removed from the ToS and can now be found in our Privacy Policy.
The other modifications are:
- The translated text in English has been extensively reviewed
- In section 2.2.1, we have changed the definition of “Personal Data” to be consistent with the definition in the Privacy Policy.
- We have moved the list of reasonable uses of the site for Premium users (section 5.2.3) to apply to all users (section 4.2.3 Use of the Accounts), avoiding duplication of text regarding the use of robots.
- In section 8 we have clarified the Creative Commons licensed data by adding “by Geneanet” and reworked the part about Geneanet use of your genealogical data.
- In section 14, we have added a phrase, designed to protect Premium members, regarding non-acceptance of future substantial changes: “Notwithstanding the foregoing, Premium members may continue to use the service in accordance with the Terms and Conditions as drafted before the changes until termination or expiry of their subscription, which will not be automatically renewed.”
In reference to section 8, the ToS are unchanged regarding the ownership of your genealogical data: “Genealogical data remains fully the property of the members who publish it on Geneanet.” The notion of “non-commercialization” is confirmed and specified: “Geneanet undertakes NOT TO SELL to third-party companies the information submitted freely and free of charge by its members”. It is specified that “non-commercialization does not prevent Geneanet from using the information submitted by its members to set up services or options reserved for its Premium members, such as research, notifications or matches”.
Use of the site after October 1, 2021 implies that you accept these changes. If you do not agree to these new terms, you may discontinue use of Geneanet, and delete your account before these Terms & Conditions become effective.
